Is Your Employer Interfering with Your Right to Unionize?
If you're thinking about forming a union at your workplace, it's important to be aware of your rights and the tactics employers may use to discourage unionization efforts. These tactics, also known as union busting, are illegal under the National Labor Relations Act (NLRA). Despite this tactic being illegal, employers will try to convince its employees to side with management to derail unionization efforts.
Union busting can look like this:
Threats or intimidation: This could include threats of funding/job loss, pay cuts, or reduced benefits if workers unionize.
Misinformation: Management may spread false information about unions or the unionization process.
Coercive questioning: Management cannot pressure you to disclose your union views or those of your colleagues.
Surveillance: Employers cannot legally spy on your union activities, such as meetings or discussions.
Remember, it is your protected right under the NLRA to form, join, or assist a union. Here's what the law guarantees:
Freedom to discuss unions: You can talk about unions with your coworkers during breaks, non-work times, and in non-work areas.
Protection from retaliation: Employers cannot fire, demote, or take any adverse action against you for participating in union activity.
